JUDGMENT 1. . - The appellant- National Insurance Company Ltd. has filed the present misc. appeal against the judgment and award dated 30.09.2013 passed by learned Judge, Motor Accident Claims Tribunal, Pratapgarh, in MAC Case No.134/2007- Mangilal & Ors. v. Hanuman & Ors. , whereby the learned Tribunal while allowing the claim petition filed by the claimants has awarded the compensation to the tune of Rs.6,23,504/- on account of unfortunate death of Smt. Asudi, wife of first respondent, Mangilal. 2. v. Mr. Rajesh Choudhary, learned counsel appearing on behalf of appellant- Insurance Company assailing the impugned judgment and award made three fold submissions, viz. (i) that in the First Information Report name of the owner of the tractor in question was given as Badrilal, Sarpanch, whereas in the claim petition and in the charge sheet, the same was set to be Vijiya Meena; and (ii) he submitted that while computing the income of the deceased, namely, Smt. Asudi, the deduction to the extent of ¼th has been made whereas it should be ?rd since the daughter of the deceased was married and one son being major (who was 22 years of age and three minor sons); and (iii) he further submitted that the age of the deceased at 35 years appears to be on lower side since her son and daughter being major of 20 and 22 years and were not dependant upon the income of the deceased, and therefore, the compensation ought to have been reduced applying the multiplier 13 instead of 16. 4. On the other hand, Mr. Bharat Singh, learned counsel for the respondents/claimants supported the impugned award and submitted that the postmortem report clearly proves the death caused by the said accident and the tractor was in the name of one Smt. Vijiya Meena only as per record in the form of documentary evidence led before the learned tribunal and Challan was also filed against the driver of the said tractor, Hanuman, by the investigating officer whom the owner of the tractor identified as his driver only. The amount of compensation is also just and reasonable and no reduction in the same is called for. He also submitted that the multiplier applied is correct since the age has been stated to be 35 years only on the basis of postmortem report, which actually could have been little more and on the other hand the age of the deceased might also said to be some more and, therefore, the compensation cannot be reduced. The future prospects of increase in income has also not been awarded. 5. Having heard the learned counsel for the parties, this Court is satisfied that the impugned award does not call for any interference by this Court in the present appeal filed at the instance Insurance Company. The findings recorded by the learned Tribunal, as quoted-above, are well reasoned findings based on relevant evidence. 5. The death was undoubtedly caused by the Tractor, which was plied by its driver, Hanuman, rashly and negligently and the tractor in question being insured with the appellant Insurance Company at the relevant point of time, the liability of paying the compensation has rightly been fastened on the present appellant Insurance Company. Merely on account of difference in the name of owner in the FIR and in the Challan filed by the Investigating Officer, and consequently in the claim petition, it cannot be said that the claim is false or forged. 6. As far as income of the deceased, Asudi, is concerned, it has rightly been determined at Rs.4316/- per month on the basis of daily wages earned and deduction of ¼th for herself, the income of was determined as Rs.3277/- and the loss of income is determined at Rs.6,21,504/- (3277 x 16) and adding the funeral expenses to the extent of Rs.2000/-, the total compensation of Rs.6,23,504/- has been awarded by the learned Tribunal, and the same in the opinion of this Court, appears to be just and fair, and therefore, does not call for any reduction at the instance of present appellant-Insurance Company. 7. Accordingly and in view of above, the present appeal filed by the appellant National Insurance Co. Ltd. is found to be bereft of any force and deserves dismissal and the same is hereby dismissed. No costs. A copy of this order be sent to the concerned parties and the learned M.A.C.T., Pratapgarh, forthwith.Appeal Dismissed. *******
