JUDGMENT : Mr. Paramjeet Singh, J. (Oral):- Present petition has been filed under Section 439 of the Code of Criminal Procedure for grant of regular bail to the petitioner in a case arising out of FIR No. 126, dated 28.06.2014, under Sections 15/61/85 of the NDPS Act, registered at Police Station Sahnewal, District Ludhiana. 2. Learned counsel for the petitioner contends that including the other weight of the bag etc., the recovery is of 57 kg. of Poppy Husk and this is marginally commercial. The learned counsel further contends that petitioner is behind bars since 30.06.2014. 3. Taking into consideration the facts and circumstances of the case and the fact that trial would not be concluded in near future, the petitioner can be granted concession of bail. 4. Without expressing any opinion on merits of the case, the petition is allowed. Petitioner is ordered to be released on bail, on his furnishing bail bonds/surety bonds, to the satisfaction of trial Court/Duty Magistrate, Ludhiana. ---------0.B.S.0------------ ————————
