JUDGMENT : Mansoor Ahmad Mir, J. It appears that similar matter was pending before this Court being CWP No. 589 of 2008, titled as M/s Gillete India Ltd. & another versus Union of India and others, which was granted in favour of the writ petitioner vide judgment and order, dated 18.12.2008, constraining the Union of India to question the same by the medium of SLP (C) No. 28539 of 2009 before the Apex Court, which is still pending. The issue involved in this case is squarely covered by the said judgment. 2. In the given circumstances, we deem it proper to dispose of this writ petition by providing that the parties shall abide by the decision to be taken by the Apex Court in the abovesaid SLP. 3. At this stage, learned counsel for the petitioner stated at the Bar that the petitioner has deposited some amount under protest. His statement is taken on record. The petitioner is at liberty to move appropriate application in case the order of the Apex Court goes in its favour. 4. The writ petition is disposed of accordingly alongwith all pending applications.
