JUDGMENT : 1. Learned counsel for the Judgment Debtors states that he has filed an additional affidavit of Judgment Debtor No. 3, under an index dated 22.5.2015, with a copy to the other side. 2. Learned counsel for the Decree Holder states that the deponent of said affidavit has not offered an unconditional apology to the Court. In support of the said submission, he draws the attention of the court to para 7 of the said additional affidavit. 3. At that stage, learned counsel for the Judgment Debtors had sought a pass over to enable him to prepare another affidavit of the Judgment Debtor No. 2 and submit it across the Board. At the request of the counsel for the Judgment Debtors, the case was passed over. 4. On the second call, learned counsel for the Judgment Debtors hands over a freshly drafted affidavit of the Judgment Debtor No. 2 and states that an unconditional apology has been tendered therein to the court and the Judgment Debtors have undertaken to abide by the terms and conditions of the judgment and decree dated 6.8.2014, passed in CS(OS) No. 1929/2011. Counsel for the Judgment Debtors assures the court that his clients shall adhere to maintaining a distance of 100 meters from the office of the Principal of the plaintiff/College, for purposes of holding demonstrations/dharnas/ meetings etc., as per the site plan enclosed with the plaint. 5. A copy of the aforesaid additional affidavit is handed over to the other side and the original is taken on record. 6. Learned counsel for the Decree Holder states that in view of the undertakings given by the Judgment Debtors in the recently handed over additional affidavit, the petition may be disposed of. 7. Accordingly, the Judgment Debtors are bound down by the undertakings given by them, in terms of the directions recorded in the judgment and decree dated 6.8.2014, passed in CS(OS) No. 1929/2011. 8. The present petition is disposed of.
