JUDGMENT 1. - Vide Order dated 6.7.2015, this Court has directed learned Counsel for the petitioner to submit requisite information along with affidavit regarding service of notice upon respondent. As per office reports dated 9.7.2015 and 1.8.2015, postal receipt and requisite affidavit have been filed respectively. Relying on the information obtained from website of Postal Department and affidavit of the petitioner, it is crystal clear that notices were served on the respondent as early as on 30.6.2015. 2. Petitioner has preferred this transfer petition under Section 24, Code of Civil Procedure, 1908 (for short, 'C.P.C.') seeking indulgence of this Court to transfer Civil Original Case No. 924/201 A - Nishant Hada v. Anju Hada , pending before Family Court No. 1, Jaipur to Family Court No. 1, Jodhpur. 3. Aforesaid Civil Original Case No. 924/2014 is laid by respondent-husband under Section 13 of Hindu Marriage Act, 1955 for dissolution of marriage before Family Court No. 1, Jaipur. 4. In the petition, it is, inter alia, averred that she is having a child of three years and is presently residing with her parents at Jodhpur, therefore, she is facing great inconvenience in attending the proceedings before Family Court No. 1, Jaipur. A reason is also cited that Jaipur is at a distance of 313 Kms. from Jodhpur, therefore, for undertaking journey, she is facing undue hardship. 5. Despite service nobody appears for the respondent-husband. 6. Having heard learned Counsel for the petitioner, in my opinion, looking to the inconvenience of the petitioner-wife, a lenient and benevolent view is desirable in the matter to facilitate her proper representation in the matrimonial case laid by the husband. It is not in dispute that in matrimonial proceedings, inconvenience and hardship of wife is to be given due credence and precedence and Courts are required to take a benevolent view while considering petition for transfer of the case. 7. Taking into account all these facts, Transfer Petition is allowed. Civil Miscellaneous Case No. 924/2014 - Nishant Hada v. Anju Hada , pending before Family Court No. 1, Jaipur is, hereby transferred to Family Court No. 1, Jodhpur. Learned Family Court No. 1, Jaipur is directed to remit the entire record of the case to Family Court No. 1, Jodhpur forthwith.Petition allowed. *******
