JUDGMENT Mr. Fateh Deep Singh, J.: (Oral) -- The allegations against present petitioner Amandeep Singh @ Mandeep are that on the report of Kulwant Singh owner of the tubewell that some narcotics substance was lying at his tubewell room and on the raid by the police on 3.8.2014, three accused out of whom present petitioner was identified by one of the official, ran away leaving behind 11 bags consisting of 20 kgs poppy husk each, totalling 220 kgs, a commercial quantity. 2. The contentions of Mr. SS Rana, counsel for the petitioner that the petitioner has not been apprehended at the spot and that his name was also not mentioned in the FIR have been opposed by the learned State counsel on the ground that the police party has identified the accused on the spot as one of the accused and it has come in the statement of ASI Amrik Singh. 3. Without adverting to the merits of the case, since prima facie commercial quantity of contraband has been recovered, impels this Court to decline the grant of bail. Hence, the present application stands dismissed. ————————
