JUDGMENT Anjani Kumar Mishra, J. Heard learned counsel for the petitioner. 2. This writ petition has been filed seeking amongst the following relief: - "(i) Issue a writ order or direction in nature of certiorari, quashing the impugned order dated 19.05.2015 passed by Civil Judge (JD), Ghaziabad (Annexure No. 8). (ii) Issue a writ, order or direction in nature of mandamus to cancel the registered agreement to sale deed dated 09.07.2014, Khasra no. 423 area 1.2550, and Khasra no. 895 area 1.7150, which is registered on Sub Register (V) Ghaziabad as Wahi No. 1 Jild No. 4422 page no. 313 to 340, kramank no. 4537 and Wahi No. 1 Jild No. 4422 page no. 341, kramank no. 4538." 3. Insofar as the order dated 19.05.2015 is concerned, by this order an application for interim injunction filed by the petitioner was rejected by the Trial Court. Against this order the petitioner has a statutory remedy by means of miscellaneous appeal under Order 43 Rule 1 (r) of the C.P.C. Admittedly, this remedy has also been availed by the petitioner. However, this writ petition has been filed on the ground that his appeal could not be taken up on account of lawyers strike. 4. Be that as it may, the petitioner is availing the proper remedy available to him and therefore, this relief prayed for, cannot be granted. 5. The second relief sought is for cancellation of a registered agreement to sell regarding which a suit has been filed and the same is pending consideration. 6. Learned counsel submits that he has prayed for this relief because in case in pursuance of the registered agreement to sell, a sale deed is executed, the rights of the petitioner will be prejudiced. Even this submission is entirely misconceived. In case, the registered agreement is cancelled by the Civil Court all actions taken in pursuance there of shall also stand cancelled. 7. Accordingly and in view of the above discussion this writ petition is entirely misconceived and is therefore, dismissed.
