JUDGMENT 1. - The appellant/claimant, Anand, has filed the present misc. appeal under Section 173 of the Motor Vehicles Act, 1988, against the order dated 21.08.2007 passed by learned Judge, Motor Accident Claims Tribunal, Pali in M.A.C. Case No.82/2006 - Anand v. Vega Ram & Ors. , whereby the learned Tribunal has awarded compensation to the appellant/claimant to the tune of Rs. 15,000/- and has prayed for enhancement of the compensation to the appellant/claimant. The appellant/claimant has filed the present claim petition claiming compensation for the injuries suffered by him in an accident which occurred on 14.07.2005 at 02.00 PM while he was going from Ghandhi Chowk to Railway Station, Pali on a motorcycle bearing No.RJ-19M-8821 with his friend, namely, Govind (Appellant in CMA No.194/08, decided today). Their motorcycle was hit backside by Truck (RJ-07-G-4647), which was plied by its driver, Vega Ram, (respondent No.1 herein) rashly and negligently. In the aforesaid accident, the claimant/appellant sustained various injuries on his body, as aforesaid. 3. Having heard the learned counsel for the appellant/claimant and the respondents/non-claimants, and considering the facts and circumstances of the case, it is considered to be a fit case to award a lump sum amount of enhancement of Rs. 5,000/- in addition to what has already been awarded by the learned Tribunal. The judgment and award passed by the learned Tribunal dated 21.08.2007 shall stand modified accordingly. The said enhanced sum of Rs. 5,000/- (Rupees Five Thousand only) be paid to the claimants within a period of three months from today and the same shall also bear the interest @ 9% per annum from the date of filing of the claim petition till the date of payment. 4. The civil misc. appeal of the claimant/appellant is, accordingly, disposed of. A copy of this order be sent to the concerned parties and the Motor Accident Claims Tribunal, Pali, forthwith.Appeal disposed of. *******
