Judgment :- 1. This Writ Petition has been filed to forbear the respondents from filling up the vacancy in the post of Anganwadi Worker in the office of the second respondent and directing the respondent to consider the petitioner for appointment to the post of Anganwadi Worker in the Office of the second respondent. 2. The case of the petitioner is that she has completed X Standard and belonged to Backward Class community. A Notification was issued for the post of Anganwadi Worker in Nilakottai Union. The petitioner applied for the said post on 24.06.2008 with relevant records. She received an unsigned, but stamped post card on 24.09.2008 informing her that there is no vacancy. According to the petitioner, others were received call letters. Therefore, she went to the place of interview, which was held in Nilakottai Integrated Children's Development Project Office/Noon Meal Centre on 25.09.2008. Nearly, 150 candidates were appeared. The petitioner submitted that the selection process was arbitrarily conducted and only selected persons were called for interview. Therefore, the petitioner has filed the present writ petition for the relief stated supra. 3. The second respondent filed counter affidavit denying the various averments made by the petitioner stating that applications were invited for appointment of 14 Anganwadi Workers in Nilakottai Union mentioned in the advertisement. The petitioner is seeking posting in Nilakottai North Centre. In the said Centre, one M.Kannagi is working as Anganwadi Worker from 1992 onwards. No applications were called for in that Centre. Therefore, a post card was sent to the petitioner informing her that there is no vacancy in Nilakottai North Centre. 4. For 14 Centres, 309 applications were received. 160 applications were rejected for overage, over qualification, long distance and there is no vacancy in the applied Centre. 149 Applicants were called for interview on 25.09.2008. Intimations were sent to the rejected applicants on 22.09.2008 for the above reason. The selection was properly conducted by proper advertisement and interview was conducted by a selection committee consisting of Programme Officer, Medical Officer, Block Development Officer and Child Development Project Officer. The petitioner was informed that there is no vacancy in Nilakottai North Centre and the petitioner has failed in IX Standard and therefore, prayed for dismissal of the writ petition. 5. Heard the learned counsel appearing for the parties. 6. From the pleadings, it is seen that the applications were called for selection of Anganwadi Worker for 14 Centres in Nilakottai Union. No applications were called for in Nilakottai North Centre, since one M.Kannagi is working as Anganwadi Worker from 1992 onwards. The petitioner applied for the said centre. Therefore, the petitioner was informed that there was no vacancy. Further, Educational qualification for Anganwadi Worker is X Standard and the petitioner is only IX Standard fail. 7. For the reason that there is no vacancy in the Centre, for which the petitioner applied for appointment of Anganwadi Worker and the petitioner is not possessing the requisite educational qualification, the writ petition is dismissed. No costs.
