Order Sanjay K. Agrawal, J. 1. Heard. The accused/applicants have moved this bail application under Section 439 of the code of Criminal Procedure for releasing them on regular bail during trial in connection with Crime No. 09/2015, registered at Police Station: Pali, District Korba (C.G.), for the offence punishable under Section 304-B/34 of the IPC. 2. The case of prosecution, in brief, is that the marriage of applicant's son Shyam Kumar Patel was solemnized with Parvati in the month of February, 2014. Further allegation of the prosecution is that the applicants along with their son, immediately after his marriage, harassed the deceased Smt. Parvati on account of demand of dowry and threated with her in cruel manner, as a result of which she committed suicide on 18.11.2014. 3. Learned counsel for the applicants would submit that the applicants have falsely been implicated in the crime in question, there is no evidence against the present applicants. F.I.R. has been lodged on 09.01.2015 with no explanation and the charge-sheet has already been filed. Applicants are father-in-law and mother-in-law, aged about 65 and 60 years and no purpose would be served by keeping them in jail. 4. On the other hand, learned counsel for the State opposes the bail application. 5. I have heard the counsel appearing for the parties and perused the case diary. 6. Taking into consideration the nature and gravity of the offence, role of the applicants in offence in question and there is general and omnibus statement against the present applicants, further considering the explanation of delay in lodging the FIR, charge-sheet has already been filed and the applicants are in jail from 21.02.2015, and applicants are father-in-law and mother-in-law of deceased I am of the opinion that present is the fit case, in which, the applicants should be enlarged on regular bail. 7. Accordingly, the bail application filed under Section 439 of the Cr.P.C. is allowed. It is directed that on furnishing a person bond in the sum of Rs. 25,000/- each with one surety in the like sum to the satisfaction of the concerned Court for their appearance as and when directed, the applicants Jagturam and Smt. Nanki Bai shall be released on bail.+
