Judgment : N. Paul Vasantha kumar, C.J. 1. This writ petition is filed, praying for issuance of writ of mandamus, directing the official respondents to demolish the illegal construction raised by respondent No.4 in the form of house being House No.13, Sector 1/A Ext. Near Government Higher Secondary School, Chhanni Himmat, Jammu without getting permission from the Jammu Municipal Corporation Jammu. For seeking such directions, petitioner has made a representation before Municipal Commissioner on 24.10.2013. 2. Learned counsel for the 4th respondent states that the building was constructed after getting the approved plan and there is no deviation in the same. 3. Without going into the rival contentions of the parties, this petition is disposed of directing respondent No.2 (Commissioner, Jammu Municipal Corporation) to consider the aforesaid representation in accordance with law after giving opportunity of hearing to the petitioner as well as 4th respondent and pass appropriate order within eight weeks from the date of receipt of copy of this order. 4. Connected applications also stand disposed of.
