JUDGMENT Rajan Roy, J. Heard. 2. The petitioner claims to be a Teacher in Basic School run by the Basic Shiksha Parishad. He claims the benefit of continuance in service till 31.3.2016, based on the changed Academic Session Vide Government Order dated 9.12.2014. 3. Date of the birth of the petitioner is 20.12.1952. Age of superannuation being 62 years, his date of retirement was 20.12.2014 i.e. prior to commencement of Academic Session 2015-16 w.e.f. 1st April. Therefore, the benefit of change in the Academic Session and Rule 29 of the Rules of 1981 can not be extended to the petitioner. 4. It shall, however be open to the State Government to extend the services of such teachers in view of the provision contained in the amended Regulation 21 of Chapter III of the U.P. Intermediate Education, 1921, if the same is required in the interest of students and there is shortage of teachers. 5. It shall be open to the petitioner to move appropriate application before the State Government in this regard. With the aforesaid observations, the writ petition is disposed of.
