JUDGMENT K. RAVICHANDRABAABU, J. 1. Mr. M. Raja Rajan, learned Government Advocate takes notice for the respondents and by consent of both the parties, the main writ petition itself is taken up for final disposal at the stage of admission. 2. Heard the learned Counsel appearing for the petitioner and the learned Government Advocate appearing for the respondents. 3. The petitioner is aggrieved against the order of the District Collector, Kanyakumari District rejecting the petitioner's request for permission to break and transport the rocks. The proceedings are issued under Rule 20 of the Tamil Nadu Minor Mineral Concession Rule 1959. 4. As against the impugned order, the petitioner has got right of appeal before the Director of Geology and Mining, Chennai. Accordingly, the writ petition is dismissed as not maintainable. However, without expressing any view on the contention raised by the petitioner this Court gives liberty to the petitioner to file an appeal before the Director of Geology and Mining, Chennai, within a period of two weeks from the date of receipt of a copy of this order. If any appeal is filed by the petitioner, the appellate authority is directed to dispose of the appeal and pass orders on merits and in accordance with law. No costs.
