BRIJESH KUMAR SRIVASTAVA II, SUDHIR AGARWAL

body2015
JUDGMENT 1. This is an appeal filed under Section 19 of Family Courts Act, 1984 (hereinafter referred to as ?Act, 1984?) against the order dated 29.04.2015 passed by Additional Principal Judge, Family Court, Meerut on an application moved under Section 24 of Hindu Marriage Act, 1955 (hereinafter referred to as ?Act, 1955?) partly allowing the same and directing the appellant to pay Rs. 3000/- per month towards maintenance, Rs. 50/- towards litigation expenses on every date and Rs. 3000/- as lump sum for litigation and other expenses. 2. From the record, it is evident that Court below has found that defendant-appellant was not making any payment towards maintenance and though it found that higher amount would have been justified for the purpose of maintenance, but at this stage it has granted only Rs. 3000/- per month. It cannot be said that the aforesaid amount is excessive or unjust in any manner. It is also not the case of appellant that applicant-respondent has any other source of income to maintain herself. 3. In the circumstances, we find no merit in this appeal. 4. Dismissed.
