JUDGMENT 1. The delay in filing this appeal having been condoned vide order of date passed on Delay Condonation Application, let the appeal be registered with regular number and the old number shall also continue to be shown in bracket for finding out details of case, whenever required by parties with reference to either of the two number. 2. As requested by learned counsel for appellant, we proceed to hear the appeal for admission today itself. 3. Heard Sri A.P. Mishra, learned counsel for appellant. 4. This appeal under Section 19 of Family Courts Act, 1984 (hereinafter referred to as "Act, 1984") has been filed against the divorce decree passed by Principal Judge, Family Court, Varanasi vide judgment dated 18.1.2015 under Section 13B of Hindu Marriage Act, 1955 (hereinafter referred to as "Act, 1955") with the consent of both the parties. The judgment clearly states that before the Court below, both the parties appeared and clearly stated that it is not possible for them to stay as husband and wife and, therefore, they should be granted decree of divorce. In relation to the petition, I queried the parties in detail, whereupon it has been stated on behalf of the parties that it is not possible for them to live together as husband and wife, and they have been living apart for the last one year and a half and have not established any physical relation during this period. Their marriage may please be dissolved by mutual consent. In this connection, statements of the parties given on oath were recorded with the petitioner Karun Devi as PW-1 and the opposite/second party Amit Mishra as DW-1." 5.

In none of the grounds taken by appellant, it is said that she did not appear before the Court and did not make this statement. Once she has appeared before the Court below and has consented for decree of divorce, against the consented decree, no appeal lies. Therefore, this appeal is not maintainable and even otherwise has no merits. 6. Dismissed.
