JUDGMENT ANOOP V. MOHTA, J. 1. Rule. Rule is returnable forthwith. Heard finally by consent of parties. 2. We have heard the parties and as pointed out the provision and the other rules, the Counsel for the Respondents sought time to take instruction. The matter was adjourned to file affidavit. 3. Respondents No. 3 and 4 has filed affidavit dated 24.07.2015 on record accordingly. The contents of the affidavit are as under:- “2. I further say and submit that for admission to B.V. Sc. & A.H. Degree Course (5 years), we adopt the merit list prepared by Director of Medical Education & Research, Mumbai after holding Common Entrance Test (i.e. MHCET). For the academic year 2015-16, out of all the students who had passed MHCET-2015, about 4063 students had applied for B.V. Sc. & A.H. Degree Course. However, the applications of 473 students were rejected by us because they had not submitted Domicile Certificate. 3. I say that the State Government has now issued a Corrigendum to the G.R. No. MPW-2012/P.K.32/PDM1, dated 11th June, 2013. Vide the said Corrigendum, Shuddhipatrak No. MPW-2012/P.K.32/PDM1, dated 21st July, 2015, the State Government has inter alia declared that candidates/parents who have resided in Maharashtra for a period of not less than 3 years out of immediately preceding 10 years would not be required to submit Domicile Certificate for admission to B.V. Sc. & A.H. Course for the year 2015-16. 4. I further say that in view of the above, now the University has decided to reschedule its admission programme. Accordingly the University has now notified on its website that those students whose applications were rejected for want of Domicile Certificate too are considered as eligible for admission to B.V. Sc. & A.H. Degree Course. The University shall also send SMS alert and email to all the students informing the rescheduled Admission Programme. The final eligibility list was originally scheduled to be published on 24th July, 2015 and now with rescheduling of admission programme, it will be delayed by about 1015 days. The names of these 473 students will be included in final eligibility list. Thereafter the selection rounds will be held. 5. I most respectfully submit that the above information is submitted to this Hon’ble Court for necessary order.

The University shall act as per the order that may be passed by this Hon’ble Court in this matter.” It is necessary for the Respondents to give due publicity to above Government's amended resolution at earliest. 4. We appreciate the approach shown by the concerned Department and the Officers of the Respondents and the respective Advocates in resolving the issue by taking such positive action immediately. 5. In view of above, the present writ petition is disposed of. The Respondents to take steps as early as possible. 6. No costs.
