JUDGMENT : 1. Heard Mr. D. Pangam, learned Counsel appearing for the petitioner, Mr. S. Redkar, learned Counsel appearing for respondent no.1 and Mr. A. Halarnkar, learned Counsel appearing for respondent no.3. 2. Rule. Heard forthwith with the consent of the learned Counsel. Learned Counsel appearing for the respondents waive service. 3. During the course of the hearing of the above petition, Mr. S. Redkar, learned Counsel appearing for respondent no.1, upon instructions, states that he will withdraw the application at Exhibit 6 before the Executing Court filed by respondent no.1, without prejudice to his rights to take appropriate remedies in accordance with law. 4. Application stands accordingly dismissed as withdrawn. In view of the withdrawal of the said application the impugned order passed by the learned Judge dated 24/02/2014 shall no longer survive and stands accordingly quashed and set aside. Rule stands disposed of.
