JUDGMENT 1. - The instant bail application has been filed by the petitioner under Section 439 Cr.PC. who is in custody in connection with F.I.R. No. 113/2015, Police Station Ganj, Ajmer for the offences under Sections 302/34 and 341 IPC. 2. Learned counsel for the petitioner contends that the petitioner has been falsely implicated in this case and no incriminating recovery has been effected from him and he has been charge-sheeted without any justification. Thus he prays that the petitioner deserves to be released on bail. 3. Learned Public Prosecutor, on the other hand, opposed the arguments advanced by the learned counsel for the petitioner. But, he too is not in a position to dispute the fact that there is no significant evidence available on record to connect the petitioner with the crime. 4. Heard learned counsel for the parties and perused the material available on record. 5. Having considered the arguments advanced by the parties, but without expressing any opinion on the merits of the case this Court is of the opinion that it is a fit case for grant of bail to the petitioner. 6. Accordingly, this bail application is allowed and it is directed that the petitioner Shailender @ Chinu @ Sitya S/o Shri Hanuman Singh arrested in connection with the F.I.R. No. 113/2015, Police Station Ganj, Ajmer shall be released on bail provided he furnishes a personal bond of Rs. 50,000/- and two surety bonds of Rs. 25,000/- each to the satisfaction of the learned trial court with the stipulation to appear before that Court on all dates of hearing and as and when called upon to do so.Bail Applicable Allowed. *******
