JUDGMENT 1. - By way of this bunch of writ petitions, the petitioners who are retired employees of R.S.R.T.C. seek a direction to be issued to the respondent Corporation for releasing their retiral and other benefits including overtime, night allowance, earned leave, etc. 2. The liability of Corporation to reimburse its employees' retiral and other service dues is not disputed. However, the quantification of the dues is still pending affirmation for lack of information and other reasons. 3. The petitioners retired long time back from the Corporation but are still being deprived of the aforesaid benefits for the ostensible reason that the Corporation is running into huge losses. While considering some of the matters, on the previous dates of hearing, this Court with the assistance of Mr. P.R. Singh, learned counsel representing the R.S.R.T.C. as also in the capacity of Addl. Advocate General, State of Rajasthan, summoned the Finance Secretary, Government of Rajasthan, so as to explore the possibility of the State Government providing financial assistance/bail out package to the Corporation for reimbursing the terminal and other dues of its retired employees. Today, during the course of hearing Mr. P.R. Singh has placed on record, copies of the orders issued by the Finance Department, Government of Rajasthan, as per which convertible interest free loan to the tune of Rs. 15000 lacs is proposed to be released to the Corporation in lieu of transfer of R.S.R.T.C. properties to the Rajasthan State Bus Terminal Development Authority during the course of the next six months. 4. In a few of the matters, this Court has already directed the Corporation to release 50% of the due amount to the petitioners and payment has also been made pursuant thereto. 5. A bunch of writ petitions preferred by the Corporation's retired employees at Jaipur Bench led by S.B. Civil Writ Petition No. 14748/2014 Prahlad Singh v. Managing Director, Rajasthan State Road Transport Corporation & Ors. involving the very same controversy has been allowed by order dated 28.9.2015 and the Corporation has been directed to make payment of the entire dues to its retired employees within a period of six months with interest @ 6% p.a. 6. The State has already extended a bail out package in the form of convertible interest free loan to the Corporation pursuant to the observations made by this Court on 4.7.2015 in C.W. Thus now there is no reason to withheld the dues of the Corporation's retired employees. 7. In this background, these writ petitions deserve to be and are hereby allowed. The respondent Corporation is directed to reimburse the entire dues of all its retired employees under all heads including retiral benefits, overtime, night allowance, earned leave etc. within a period of six months. The due amount shall carry interest @ 6 p.a. from the date of accrual till the date of actual payment. The petitioners shall be at liberty to submit detailed representations to the concerned officers to settle the accounts and facilitate the assessment of the dues at the earliest.No order as to costs.Petition allowed. *******
