JUDGMENT 1. (Oral) - This second appeal under Section 100 of the Code of Civil Procedure filed by the plaintiff is arising out of the judgment and decree dated 23.04.2008 by the learned Additional District Judge No.2, Jodhpur in Civil Appeal (Decree) No.64/1986 "LR's of Heera Lal v. Gopal & Anr." who dismissed the appeal filed by the appellant-plaintiff and affirmed the judgment and decree dated 19.07.1984 passed by the learned Munsif & Judicial Magistrate, First Class, Phalodi, District Jodhpur in Civil Original Suit No.55/1978 "LR's of Heera Lal v. Gopal" by which, the learned Trial Court had dismissed the suit filed by the plaintiff-LR's of Heera Lal seeking declaration and recovery of possession in respect of the suit property situated at Dholabala, Phalodi City viz. a plot of land admeasuring 151 gaj x 151 gaj. 2. The present second appeal has been filed by the appellant-Dev Kishan, who is one of the legal representatives of Heera Lal, along with other legal representatives of late Heera Lal, before the learned two Courts below, against the concurrent rejection of their suit, as aforesaid. 3. After framing of the relevant issues arising out of the plaint and written statement and after recording of the evidence, the learned Trial Court had dismissed the suit of the plaintiff-LR's of Heera Lal on 19.07.1984.

Being aggrieved by the judgment and decree of rejection of suit aforesaid dated 19.07.1984, the plaintiff-LR's of Heera Lal filed the first appeal before the first appellate court of learned Additional District Judge No. 2, Jodhpur namely, Civil Appeal (Decree) No. 64/1986 "LR's of Heera Lal v. Gopal & Anr." which was also dismissed on 23.04.2008, while affirming the impugned judgment and decree dated 19.07.1984 of the learned Trial Court.

Having heard the learned counsel for the parties and upon perusal of the impugned judgments and decrees of the both Courts below, this Court is satisfied that no substantial question of law arises for consideration by this Court in the present second appeal filed by the appellant-plaintiff-Dev Kishan S/o Heera Lal since deceased through LR's. In the circumstances of the case, the findings of facts about the plaintiff having failed to prove any encroachment of the defendants over his land in dispute and further failed to prove that the alleged Varrandah had been constructed by the defendants in the land of the plaintiffs, therefore, these findings cannot be said to be perverse in any manner and the said orders do not give rise to any substantial question of law in this second appeal and this second appeal of the appellants-plaintiffs-LR's of Heera Lal deserves to be dismissed being devoid of any merit. The findings of facts arrived by both the Courts below are correct and based on relevant and cogent evidence led by the parties before the Courts below. This Court finds no force in the present second appeal of the appellant-plaintiff-Dev Kishan S/o Heera Lal since deceased through LR's. 6. Accordingly, the present second appeal filed by the appellant-plaintiff-Dev Kishan S/o Heera Lal since deceased through LR's is dismissed. No costs. A copy of this order be sent to both the Courts below and the parties concerned forthwith.Appeal dismissed. *******
