JUDGMENT Mrs. Sunita Agarwal, J. Heard learned counsel for the parties. 2. The release application filed by the landlord on the ground of bonafide need under section 21(1) (A) of the Rent Control Act has been allowed by both the court below. The concurrent findings have been recorded by the court below that petitioner-tenant is in occupation of newly constructed house and has not been able to assail before the courts below that the house was not available to him in a vacant state. The petitioner being owner of the house no. 116/200 Adrash Nagar Rawarpur, Kanpur Nagar, was found not entitled to contest the release application filed on the ground of personal need of the landlord. The landlord's need was found genuine and pressing. 3. Learned counsel for the petitioner has not been able to rebut the findings of fact recorded by the courts below. No interference is required in the orders passed by both the courts below. 4. Learned counsel for the petitioner lastly submits that the petitioner-tenant undertakes to vacate the premises in question within a period of one month. He may be granted time to vacate the premises. 5. In view of this submission, it is provided that : - 1. The petitioner shall file an undertaking in the form of an affidavit before the court below within a period of two weeks along with certified copy of the order. 2. In case, the petitioner files such an undertaking he may be allowed to vacate the premises on or before 6th August, 2015. 3. In case, the petitioner fails to handover the vacant possession on the date fixed despite the undertaking, appropriate proceeding for eviction be initiated and proceeded in accordance with law. 6. With these observations, the writ petition is dismissed.
