JUDGMENT : P.S. RANA, J. Heard. Learned Advocates appearing on behalf of parties submitted before the Court that compromise has been executed inter se parties and compromise decree be passed in present C.S. No. 4035 of 2013. Court is satisfied that lawful compromise has been executed inter se parties. In view of the above stated facts C.S. No. 4035 of 2013 is compromised as per terms and conditions mentioned in compromise Ex-PA. Final decree of partition is passed strictly as per compromise Ex-PA placed on record. Documents Ext-PB, Ext-PC, Ext-PD, Ext-PE, Ext-PF, Ex-PF-I, Ext-PG and Ext-PH will form part and parcel of final partition decree. Statements of Narayan Singh and M.K. Udai Prakash recorded today and placed on record will also form part and parcel of final partition decree. Registrar (Judicial) will prepare final partition decree under Order 23 Rule 3 CPC strictly as per compromise Ex-PA placed on record within fortnight. Compromise order and decree will be binding upon plaintiff and defendant only and will be not binding upon any person who is not co-party in C.S. No. 4035 of 2013. No order as to costs. C.S. No. 4035 of 2013 is disposed of accordingly. Pending applications if any also disposed of.
