JUDGMENT Mr. Naresh Kumar Sanghi, J.: (Oral) - Prayer in this petition, filed under Section 439, Cr.P.C., is for grant of regular bail to the petitioner, Ramandeep Singh @ Depu, son of Ishwar Singh, resident of House No,9, Mohalla Arjan Colony, Loharan Kalan, Nabha City, District Patiala, who has been booked for having committed the offences punishable under Sections 120-B, 323 and 363-A, IPC, in a case arising out of FIR No.107, dated 31.12.2014, registered at Police Station, Koom Kalan, District Ludhiana. 2. Learned counsel contends that except the disclosure statement, which is in the shape of confession of the co-accused, there is no other material to connect the petitioner with the alleged kidnapping of Mukaddar, a boy aged one year; the petitioner is neither named in the FIR nor any other material has emerged on record to connect him with the alleged offences for which he has been booked; co-accused Tej Kaur, who is mother of the petitioner, has already been arrested. 3. Learned counsel for the State has not controverted the factual aspect that except the disclosure statement of the coaccused of the petitioner, there is no direct evidence to connect him (petitioner) with the alleged offences. 4. Keeping in view the totality of the facts and circumstances of the case, the present petition is allowed. Petitioner-Ramandeep Singh @ Depu, son of Ishwar Singh, resident of House No,9, Mohalla Arjan Colony, Loharan Kalan, Nabha City, District Patiala, is ordered to be released on bail during pendency of the trial of the present case subject to his furnishing bonds to the satisfaction of learned Chief Judicial Magistrate/Duty Magistrate, Ludhiana. 5. The observations made hereinabove are for the limited purpose of deciding the present petition. —————————
