JUDGMENT 1. (Oral) - The present second appeal under Section 100 of the Code of Civil Procedure has been filed by the plaintiff-Ram Chandra S/o Kashtoor Chand being aggrieved by the reversal of the decree by the first appellate court by the impugned order dated 27.03.1986 allowing the defendant-Nand Lal's appeal, namely Appeal No. 23/1985 : Nand Lal v. Ram Chandra & Purshottam . 2. 2. The appeal filed by the defendant-Nand Lal, however, came to be allowed by the first appellate court of learned Additional District Judge, Rajsamand allowing the Appeal No. 23/1985 : Nand Lal v. Being aggrieved, the plaintiff-Ram Chandra has filed the present second appeal in which, the following substantial questions of law were framed by the co-ordinate Bench of this Court on 12.01.1987 which read as under:- "(1) Whether the learned Appellate Court is right in not deciding the specific objection raised by the plaintiff/appellant that trial court has wrongly refused permission for production of secondary evidence in respect of the patta obtained by late Shri Chunni Lal-father of the defendants from Thikana Kankroli in respect of this land ? (2) Whether the learned lower Appellate Court was right in reversing the trial Court's decision raising adverse inference for non-production of the title deed of the dispute land which is admittedly in possession of the defendant ? (3) Whether the learned lower Court is right in reversing the trial Court's decision holding that Purshottam and thereafter the plaintiff was in rightful possession of the disputed land and Purshottam had rightfully sold the land to the plaintiff ?" 5. The learned counsel Mr. Manish Shishodia appearing for the plaintiff-appellant-Ram Chandra submitted that the both the learned Courts below have erred in not permitting the defendant to adduce the secondary evidence of the original patta on the basis of which, he claimed title over the disputed plot of land whereas, the same has been sold by the defendant-Purshottam by asserting that he and Nand Lal, both are the sons of Chunni Lal Paliwal and he had one-third share in the property, i.e., the agricultural land in question, by executing a registered sale deed in favour of the plaintiff-Ram Chandra. The learned counsel also submitted that at the earlier point of time, the application filed in this regard came to be rejected by the learned Trial Court vide order dated 16.05.1978. The learned counsel submitted that the appellant has filed an application under Order 41, Rule 27 of the Code of Civil Procedure along with a photocopy of the said patta, which prima facie indicates that the said patta was issued by Murtiba Kachhari Maal Sansthan, Shri Kankroli in the Samvat Year 2005 in favour of the said Chunni Lal Paliwal S/o Tulsidas Paliwal of Kankroli, whose sons are the defendants in the present suit. The learned counsel Mr. Manish Shishodia submitted that in the above circumstances of the case, the application filed by the appellant under Order 41, Rule 27 of the Code of Civil Procedure deserves to be allowed and the learned Trial court deserves to be directed to try the suit afresh, while taking the aforesaid piece of evidence into consideration. 6. Though, these submissions made by the learned counsel for the appellant Mr. Manish Shishodia are opposed by the learned counsel Mr. L.R. Mehta & Mr. 6. Mehta & Mr. Ramit Mehta appearing for the respondents-defendants with the submissions that the learned Trial Court had already dismissed the application earlier filed by the plaintiff-Ram Chandra in this regard refusing to take the copy of the patta as secondary evidence, but this Court is of the considered opinion that the aforesaid piece of evidence, i.e., the copy of the patta, is relevant evidence in the present controversy and, therefore, the same deserves to be considered by the learned Trial Court depending upon the proof led by the parties before it, since the defendant-Nand Lal has claimed that he is the exclusive owner of the land in question and the another defendant-Purshottam, his brother had no right to sell the same in favour of the plaintiff-Ram Chandra, therefore, burden to prove his title is essentially on the defendant-Nand Lal before the learned Trial Court. 7. Be that as it may, for the present purposes, this Court is satisfied that the said evidence, i.e., the photocopy of the patta, deserves to be taken on record as secondary evidence and taken into account by the learned Trial Court. Therefore, the application filed by the plaintiff-appellant under Order 41, Rule 27 of the Code of Civil Procedure deserves to be allowed; and as a consequence thereof, the impugned judgments and decrees of both the Courts below dated 27.03.1986 and 22.05.1985 deserve to be set aside and the effect of the above order will be that the trial of the suit will be restored to the learned Trial Court for trial afresh in accordance with law. 8. Accordingly and in view of the above, the above framed and quoted substantial questions of law are not required to be answered on merits at this stage. Both the impugned judgments and decrees of the learned Courts below dated 27.03.1986 and 22.05.1985 are set aside. The trial of the original suit is restored back to the learned Trial Court in view of the aforesaid order of allowing the application of the appellant filed under Order 41, Rule 27 of the Code of Civil Procedure.
