Judgment : 1. This writ petition is filed praying for issuance of writ of mandamus directing the respondents to consider the petitioner for appointment in light of SRO 43 of 1994 by taking note of the law laid down by this Court in case titled Jia Lal vs. Union of India and ors (2001) KLJ 623. 2. The case of the petitioner is that his father Basant Kumar, who was initially appointed as daily wager and regularized in the pay scale of Rs.2550-3200 expired on 10th of July 2003 while in service leaving behind the petitioner and other family members. The petitioner being the only son submitted an application before respondent No.4 on 06.12.2006 seeking appointment on compassionate ground. On 17.07.2007 respondent No.4 forwarded the application to respondent No.3 to consider the case of the petitioner for compassionate appointment. On 06.02.2007 respondent No.2 requested respondent No.1 to appoint the petitioner as class IV in the department after proper verification of the case of the petitioner. Despite communications dated 17.01.2007 and 06.02.2007, the petitioner has not been appointed on compassionate ground, therefore, the petitioner filed the present writ petition. 3. While entertaining the writ petition, this Court directed the respondents to expedite the case of the petitioner as recommended vide communication dated 06.02.2007. Respondents filed objections stating that the case of the petitioner is under consideration and order shall be passed by the competent authority. 4. The eligibility of the petitioner to claim compassionate appointment is not in dispute. In such circumstances, if no order has been issued as on today in favour of the petitioner for appointing him under compassionate ground, 2nd respondent is directed to pass necessary order in this regard within a period of six weeks from the date of receipt of copy of this order.
