JUDGMENT 1. - Instant petition has been filed under Section 482 Cr.P.C. praying interalia that the order dated 29.09.2015 passed by learned Special Judge (Fake Currency Cases) and Additional District and Sessions Judge, Jaipur Nagar Jaipur whereby he dismissed the revision petition no.175A/15 and upheld the order dated 21.09.2015 passed by Metropolitan Magistrate No.20 Jaipur Metropolitan in Criminal Case No.385/2007 (State v. Sameer Khandelwal) whereby he dismissed the application u/s 70(2) Cr.P.C. for converted the non bailable warrant into the bailable warrant may be quashed. 2. After hearing the learned counsel for the parties, the present petition is disposed of by issuing direction to the Court of learned Metropolitan Magistrate No.20 Jaipur Metro Jaipur that non-bailable warrant issued against the petitioner be kept in abeyance for a period of three weeks to enable the petitioner to surrender and apply for regular bail. 3. Needless to say, the application for bail to be filed by the petitioner shall be decided in accordance with the provisions of law uninfluenced by any observations made by this Court in this order. 4. It is further clarified here that in case the petitioner fails to appear before the Court below within the stipulated period of three weeks from today, the present order shall cease to operate and the law shall take its own course. 5. Upon disposal of the main petition, the stay application, filed therewith, does not survive; same is also disposed of.Petition disposed of. *******
