JUDGMENT Naheed Ara Moonis, J. Heard learned counsel for the applicants and learned AGA. 2. The instant application has been filed by the applicants with a prayer to quash the entire proceeding arising out of case crime no.3 of 2015, under Section 395 IPC, P.S. Nagina, District Bijnor whereby non-bailable warrant has been issued against the applicant by order dated 14.5.2015 and proceeding under Section 82 /83 Cr.P.C. has also been initiated agaiinst him. 3. The submission of learned counsel for the applicants is that the applicants are now ready to appear before the court concerned and to cooperate with the trial proceeding hence some protection may be granted. 4. Without entering into the merits of the case it is provided that the applicants shall appear before the court concerned within three weeks from today. Till then no coercive action shall be taken against the applicants who may move application for bail before the court below which shall be decided expeditiously keeping in view of the settled law laid down by the Seven Judges' decision of this Court in the case of Amarawati & another Vs. State of U.P. reported in 2004 (57) ALR 290 and is also approved by the Apex Court in Lal Kamlendra Pratap Singh Vs. State of U.P. 2009 (2) Crimes 4 (S.C.) after hearing the Public Prosecutor. With the aforesaid observations, the application is disposed of.
