Judgment : 1. This writ petition is filed praying for quashing order dated 29.08.2006 to the extent as cadre of the petitioner shown as Peon and for a directions to the respondents to place the petitioner in the cadre of Laboratory Bearer being class-IV employee from the date of appointment. 2. The case of the petitioner is that he being a matriculate was appointed as Class-IV employee in the Education Department on compassionate grounds under SRO 43 of 1994 as his father, namely, Mr. Romesh Kumar while serving as teacher in Government Primary School, Pothi in Poonch District, died in harness on 23.12.2004. The petitioner applied for compassionate appointment and the order of appointment was given as Peon on 15.05.2006. The grievance of the petitioner is that as per SRO 43 of 1994 compassionate appointment has to be given to one of the dependents based on the qualification secured by the candidate and the petitioner being matriculate, is entitled to be appointed as Laboratory Bearer instead of Peon. Petitioner submitted a representation seeking modification of the order and the said representation is still pending. 3. Since the representation of the petitioner is pending as on date, this writ petition is disposed of with a direction to the first respondent to consider the claim of the petitioner seeking the post of Laboratory Bearer instead of Peon and pass appropriate order on merits in accordance with law within a period of eight weeks from the date of receipt of copy of this order.
