JUDGMENT 1. - The present revision petition has been filed by the defendant-petitioners against the order dated 13.08.2015 passed by the learned trial court of the Civil Judge (East), Bhilwara, whereby the application under Order 7, Rule 11 of the CPC filed by the defendants-petitioners in C.O. Having heard the learned counsels for the defendant-petitioner and upon perusal of the impugned order, this Court is of the opinion that the present revision petition deserves to be disposed of with the following direction and the same is accordingly disposed of with the direction to the learned trial court to frame issue regarding res judicata as a preliminary issue and to decide the same in accordance with law, while deciding the other issues.
