JUDGMENT : Suresh Kait, J. 1. Instant petition received on transfer. 2. Vide the present petition under Section 439 Cr PC petitioner seeks extension of interim bail for a period of another three months in case FIR No. 189/2014 registered at police station Mehruali, New Delhi for the offences punishable under Section 302/307/34 of the IPC read with Sections 25/27 of the Arms Act, 1959. 3. Vide order dated 06.07.2015 passed by this Court the petitioner was released on interim bail for a period of three months on medical grounds. 4. Learned counsel appearing on behalf of petitioner submitted that petitioner is still under treatment in Maharaja Agrasen Hospital and admitted in ICU. As per the status report filed by the State and the certificate issued from the said hospital dated 10.10.2015, it is reported that petitioner is in hospital since 29.09.2015. He has been having recurrent episodes of seizures, episodes of tachycardia, hypertension and chest pain and is under treatment in consultation with neurologist and physician. He is admitted in ICU Heart Command and his disease is still unstable, and he may be required hospitalisation for 08-10 more days. 5. Keeping in view the facts and circumstances of the case and treatment of petitioner, his interim bail is further extended for a period of three months from the last period on the earlier terms and conditions, as was directed vide order dated 06.07.2015. 6. Learned counsel for petitioner has undertaken not to dispute the identity of the petitioner and to argue the matter before learned Trial Court on charge and petitioner shall be produced in the Trial Court, if he is discharged from the hospital at the time of framing of charge, if so directed by learned Trial Court. 7. In above terms, instant petition stands allowed and disposed of.
