JUDGMENT 1. - In the instant contempt petition preferred under Section 12 of the Contempt of Courts Act, 1971 read with Article 215 of the Constitution of India, a grievance has been made by the petitioner that the order dated 22.11.2010 passed by ld. Single Judge in S.B. Civil Writ petition No.1122/2001 has not been complied with. 2. In the present case, petitioner is a lady. She was appointed with respondents as Teacher on 03.11.1970. She was promoted as Headmistress. She had continuously worked with respondents till 13.05.1987. She superannuated from service on 31.03.1999. She was not paid due pension. She filed a petition, bearing S.B. Civil Writ Petition No.1122/2001 before this Court in year, 2001. The said petition was decided after nine-years i.e. on 22.11.2010 and ld. Single Judge of this Court had issued following direction:- "In the result, writ petition is allowed. Respondents are directed to compute the proportionate pension of the petitioner and Gratuity on the basis of service rendered by her from 3/11/1970 till 13/5/1987 and make payment of the same to her together with interest @ 6 p.a." 3. The present contempt petition was filed in the year, 2011. Fourteen-years have elapsed from filing of the writ petition, five-years from passing of impugned order of ld. Single Judge and four-years from filing of the present contempt petition. 4. Admittedly, the order passed by ld. Single Judge of this Court has attained finality. There is no justification for the respondents not to pay the pension to the poor lady, who, as per date of retirement, as on today, is seventy-four years old. 5. Mr. Babu Lal Meena, Director, Elementary Education, Education Directorate, Bikaner is present in person before this Court. He prays that another one month's time may be granted to find out the papers of the petitioner so that sanction order can be obtained for payment of pension. It is admitted that after completing all formalities, papers will go to Director of Pension. Thereafter, opinion will be obtained from Director, Secondary Education and thereafter, from Department of finance, sanction will be obtained for the payment of interest @ 6% per annum. 6. The public officials have to perform their duties to wipe the tears of the old and needy persons. They have essentially to perform the public duty. Facts of the present case prove that public officials lack required sensitivity. 7.

It is travesty of justice that having filed writ petition in 2001 and having succeeded in the litigation in year, 2010, and filing of the present contempt petition in 2011, till today the petitioner/old lady has not been paid a single penny. 8. This Court is hesitant to punish the public officials, while exercising contempt jurisdiction, Jail is not an answer to all ills which infest our society, but at the same time, no premium can be extended to inefficiency. 9. This Court, while exercising contempt jurisdiction has to daily deal with thirty/forty contempt petitions, merely on the ground that the orders passed by this Court are not taken in right earnest by the public officials. 10. Not to obey the order passed by this Court is dangerous disease prevailing in the State. Therefore, drastic remedy is called for. 11. Hence, a direction is, hereby, issued to the State Government that till all pension dues of the petitioner, including arrears are paid, no salary shall be paid to the Director, Elementary Education, Director Pension and Director, Secondary Education, Education Directorate. As and when payment of all dues is made, State Government shall release the salary to the above officials. Three above officials, if so advised, may hold 'Pension Lok Adalat" pertaining to their Departments so that all pending pension cases of the officials of these Departments are resolved. 12. To await compliance of this order, list in the month of March 2016. 13. However, liberty is granted to the petitioner to file an application for modification of the order, as and when payment is made. 14. Let a copy of this order, under the seal and signature of the Court Master, be handed over to Shri J.M. Saxena, ld. Additional Advocate General appearing for the respondents for onward transmission and necessary compliance to the Chief Secretary of the State of Rajasthan. 15. A copy of this order be also sent to Secretary, State Legal Services Authority for holding 'State Level Pension Adalat' in coordination with the State Government.Direction issued as above-Copy of order sent to concerned authorities. *******
