While admitting the present second appeal of the defendant-appellant on 16.08.1993, a coordinate Bench of this Court has framed the following substantial question of law for consideration by this Court:- "Whether in the facts and circumstances of the case, the plaintiff Kalyanmal, whose both parents were dead at the time of alleged adoption, could at all have been validly adopted under the Hindu Law, as it existed prior to Hindu Adoption and Maintenance Act, 1956? If not, what is its effect on the suit? 5. Learned counsel for the defendants-appellants, Ms. Arpana Bhoot urged that the plaintiff-Kalyanmal was not adopted by Nathmal, as in his own statement, he had stated that after the death of his natural parents, he was brought up by his maternal grandparents, and therefore, he could be given in adoption only by his maternal grandparents and not by his aunty (chachi), Smt.Jhamkoo. She also urged that the suit property in question, a residential room, situated in Kuchman City was given by way of license or permissive possession by Late Shri Nathmal and the decree is in respect of the possession of the said residential premises, but in view of the adoption of plaintiff-Kalyanmal not having been proved properly by the plaintiff, the question framed above deserves to be answered in favour of the defendants, and they should be allowed to remain in possession of the suit property in question. 6. On the other hand, Mr. Avin Chhangani, learned counsel for the plaintiff-respondent urged that both the learned courts below have found that there was a valid adoption of Kalyanmal by Nathmal and after the death of the natural parents of Kalyanmal, his aunty (chachi), Smt.Jhamkoo could have given Kalyanmal, who was minor at that time, in adoption to Nathmal and he has been pursuing this litigation for the decree of possession of the suit property, and therefor, his adoption cannot be questioned at this stage. He also urged that there is no contra evidence available on record to establish that no adoption of Kalyanmal to Nathmal took place. On the other hand, attention of this Court has been drawn to the customary rituals undertaken by the family members at the time of adoption, as duly noted by the learned courts below, in their impugned orders. 7. I have heard the learned counsels for the parties at some length and perused the orders of the learned courts below, discussing the relevant evidence in the matter. 8. This Court is of the considered opinion that the adoption of Kalyanmal, the plaintiff, by Nathmal, as a matter of fact, has been found, and rightly so by the learned courts below based on the relevant evidence, oral in nature, that there was adoption of plaintiff-Kalyanmal by Nathmal. As a matter of fact, the statement of defendant-Chhotulal in other judicial proceedings (Exhibit-7) was relied upon by the learned courts below, mainly in which defendant-Chhotulal himself admitted before the civil court that the said Kalyanmal was adopted by Nathmal. The learned courts below therefore, held that he could not take a contrary stand in the present suit. Admittedly, he was in possession of the suit property, a residential room, situated at Kuchaman City on the basis of a oral licence or permissive possession given by Late Shri Nathmal to him. There being no other contrary documentary evidence to show that the licence was in perpetuity, such license should be deemed to have come to an end on the death of the licensor-Late Shri Nathmal. 9. In view of the finding of adoption of Kalyanmal by Nathmal being essentially a finding of fact, and the said Kalyanmal having filed the present suit as plaintiff, which has been decreed by both the learned courts below in his favour concurrently, this Court has little doubt that the validity of the adoption cannot be questioned at this stage. This Court does not have any contra evidence before it to take a different view of the matter than the one taken by the learned courts below concurrently. 10. Therefore, the present appeal of the defendants is liable to be dismissed and answering the question of law quoted above against the defendants-appellants and in favour of the plaintiff-respondent, the present second appeal of the defendants is dismissed and it is directed that the appellant-defendants shall hand over the peaceful and vacant possession of the suit property in question to the respondents-plaintiffs on or before 24.02.2016 and shall pay mesne profit @ Rs. 500/- per month (Rupees Five Hundred only) commencing from the month of December, 2015 and will further continue to pay the mesne profit each month by 15th day of the next succeeding month or in advance to the respondent/plaintiff also and in case there is any default in payment of mesne profit, the period of Three Months for handing over the vacant and peaceful possession shall stand reduced and the decree of possession would become executable forthwith. The appellant/defendants shall also clear all the arrears of rent and mesne profit and pay the same to the respondent/plaintiffs within three months from today, otherwise the same will bear interest @9% per annum. The appellant/defendants shall also not sub-let, assign or part with the possession of the suit property in question or any part thereof in favour of any one else and would not create any third party interest in the same during the aforesaid period and if it is so done, the same would be treated as void. The appellant-defendants shall furnish a written undertaking incorporating the aforesaid conditions in the trial court within one month and one copy thereof along with affidavit, in this Court. It is made clear that if the peaceful and vacant possession of the suit premises is not handed over to the respondent-plaintiff within a period of Three Months from today or mesne profits are not paid as directed above, besides the expeditious execution of the decree in normal course, the respondent-plaintiff shall also be entitled to invoke the contempt jurisdiction of this Court. No costs. Copy of this order may be sent to the concerned parties as well as the learned courts below forthwith.Appeal dismissed. *******
