JUDGMENT 1. (Oral) - The appellants/plaintiffs, having lost the legal battle before the two courts below concurrently, have preferred this second appeal under Section 100 of CPC, 1908, assailing the validity of judgment and decree dated 07.10.1993 passed by learned Civil Judge, Udaipur, in Civil Appeal No.3/1990 (46/1986)- Nemichand v. Smt. Jassi Bai & Ors. , whereby the appeal filed by the plaintiff/appellant against the judgment and decree dated 31.03.1986 passed by learned Munsif City (North), Udaipur, dismissing plaintiff's Suit No.289/1976- Nemichand v. LR's of Devilal & Ors. , claiming easementary rights with respect to a common wall between the two parties situated on the second floor of the residential house, was dismissed. 2. , whereby the appeal filed by the plaintiff/appellant against the judgment and decree dated 31.03.1986 passed by learned Munsif City (North), Udaipur, dismissing plaintiff's Suit No.289/1976- Nemichand v. LR's of Devilal & Ors. , claiming easementary rights with respect to a common wall between the two parties situated on the second floor of the residential house, was dismissed. 2. The only question of law framed for consideration by this Court on 19.12.1996 by the coordinate bench of this Court reads as infra:- "Whether the learned trial court as well as the first appellate have misled (Sic-misread) evidence regarding Issue No.2 and 6?" 5. Mr. Alkesh Agarwal, learned counsel for the appellants/plaintiffs urged that the defendants had purchased the said suit property only in the year 1936 whereas the plaintiffs were living in the adjacent residential house since more than 100 years from now and their second floor was already constructed and from the "Jali" on the second floor in the wall, light and air used to come in their kitchen constructed on the second floor, was sought to be obstructed by the defendants after purchase of their portion in the year 1936 and further construction sought to be raised by them on the second floor and for this the suit was filed which was dismissed by the court below without reading the evidence in proper perspective, whereas the plaintiffs have urged before the learned trial court that they were already residing in the said adjacent residential house and had the right of light and air from such wall situated on the second floor. 6. These arguments are opposed by the learned counsel for the defendants/respondent, Mr. Salil Trivedi, who urged that the wall between the two residential portions of the parties was and is common wall and, therefore, the defendants also had a right to raise further construction on such common wall on the second floor; and in view of evidence of the plaintiffs led before the court below, they could not establish that the wall in question solely belonged to them (plaintiffs) and, therefore, they (the defendants) also had the right to raise the construction using the said wall, which is common between the two; and thus he submitted that this does not given rise to any cause of action to the plaintiffs and it is wrong to contend that the evidence has been misread by the courts below. 7. Having heard the learned counsel for the parties, and upon perusal of the findings of the courts below and evidence on record, this Court is satisfied that there is no misreading of evidence by the courts below on Issues No.2 and 6, as contended by the learned counsel for the plaintiffs/appellants. 7. The courts below have rightly found in favour of defendants/respondents that the Wall in question was a common wall and, therefore, the defendants/respondents were entitled to raise construction over the second floor and that has not caused any obstruction of light and air of the plaintiff. 8. Accordingly, and in view of above, the substantial question of law framed above deserves to be answered against the appellants/plaintiffs and in favour of defendants/respondents. The present second appeal of the appellants/plaintiffs is found to be devoid of any merit and the same is hereby dismissed. No costs. A copy of this order be sent to the concerned parties and the courts below forthwith.Appeal dismissed. *******
