(Oral) - The present second appeal under Section 100 CPC has been filed by the defendants-appellants-legal representatives of Late Shri Gopal Lal s/o Shri Rameshwar Lal and his brother, Bhagwan Lal, who is now represented by his legal representatives, against Shri Moda s/o Shri Dhanna Dhakad, against the decree of possession and injunction in favour of the plaintiffs-respondents concurrently given by the learned courts below. 2. 2. While admitting the present second appeal of the defendants on 10.07.1990, a coordinate Bench of this Court has framed the following substantial questions of law for consideration by this Court:- "1. Whether the learned lower courts were right in relying on a subsequently created document Ex.1 Patta as a valid deed conferring title on the plaintiff? 2. Whether in view of the contention of the plaintiff that he has been dispossessed on 7/1/77, a suit for mere injunction without seeking the relief for possession, is not maintainable and, therefore, the learned lower Courts erred in granting the decree in favour of the plaintiff?" 5. Learned counsel for the appellant-defendant, Mr.Manish Shishodia submitted that the patta issued in favour of plaintiff-Moda s/o Dhannaji was transferred by one Nanda Das, whereas the defendants had claimed before the learned court below that the suit property in question, a talia measuring 20 feet x 40 feet situated in Village Salawatiya, Tehsil Mandalgarh, District Bhilwara was transferred by Nandalal in favour of Ambalal and by Ambalal in favour of the present defendants-Gopalal and Bhagwanlal, but since the original sale deeds executed by Nanda Das and Ambalal could not be produced by the defendants-appellants, the courts below have erred in believing the patta issued in favour of Nanda Das, which was subsequently transferred in favour of the plaintiff-Moda s/o Dhannaji. He submitted that the sale deed in favour of the defendants-appellants was a unregistered sale deed also. 6. On the other hand, Mr.P.D.Vaishnav, learned counsel for the plaintiffs-respondents urged that the patta in favour of Nanda Das was validly issued and by a registered sale deed, he had transferred the same in favour of the plaintiffs, and therefore, the decree of possession as well as injunction against the defendants-appellants, had been rightly granted by the learned courts below in favour of the plaintiffs-respondents. 7. Having heard the learned counsels for the parties and upon perusal of the record of the case, this Court is satisfied that the learned courts below have not erred in granting the decree of possession as well as injunction against the defendants-appellants, and in view of the missing link of the valid sale deed in favour of the present appellants, that too claimed on the basis of an unregistered document, the learned courts below were justified in granting a decree in favour of the plaintiffs-respondents. Therefore, the questions of law quoted above deserves to be answered against the defendants-appellants and in favour of the plaintiffs-respondents. 8. Accordingly, the present second appeal filed by the defendants-appellants is found to be devoid of any merit and the same is accordingly dismissed. The questions of law quoted above are answered against the defendants-appellants and in favour of the plaintiffs-respondents. No costs.
