JUDGMENT 1. - The plaintiff-appellants - Ram Gopal Sharma, Bhanwar Lal Sharma and Nand Lal Sharma sons of Late Banshi Lal Sharma had filed the present first appeal under Section 96 CPC in this Court on 2/12/2008 being aggrieved by the rejection of their Civil Suit No. 90/2007 - Ram Gopal Sharma & Ors. v. State of Rajasthan Ors. by the learned trial court of Addl. District Judge (Fast Track) No. 2, Jodhpur on 30/8/2008. Except Ram Gopal Sharma, the two plaintiffs are now represented by their legal representatives. 2. The plaintiffs have filed the suit against the State of Rajasthan & its Devasthan Department and the dispute pertains to a Temple known as Thakurji Shri Rajgopal Ji ka Mandir, also popularly known as 'Shri Ranawat Ji Ka Mandir' situated at Hathi Ram ka Oda, Jodhpur and the suit property comprises of a Temple of the deity of Thakur Shri Rajgopal Ji, admeasuring 3798 sq.yards along with a residential unit for Pujari on the land purchased by Maharani Ajab Kumari w/o Maharaja Jaswant Singh II from one Mir Fyaz Ali for Rs. 2787/- and adjacent to it there exists a 'Nohra' ad-measuring 3794.13 sq.yards. On the suit premises of entire 7592 sq.yards, besides the Temple, 13 shops and 33 small residential units exist along with a well and the dispute between the plaintiff-appellants and the defendant Devasthan Department is as to whether the said Temple and Nohra is a Public Trust or a Private Temple or Private property of the plaintiff-appellants. 3. The present first appeal has a chequered history commencing from Samvat Year 1972 (Calendar Year 1915) and the stand of the defendant Devasthan Department right from 1963 has been that it is not a private Temple but a Public Temple and has been since registered as a Public Trust under the provisions of Rajasthan Public Trust Act, 1959 ( hereinafter referred to as the Act of 1959) by the competent authorities and appeals filed by the appellants have failed, whereas, the plaintiff-appellants seek to claim it as a private property and a private Temple on the basis of the 'Bhaitnama' (Gift Deed) by Maharani Ajab Kumari in favour of their grand father Mahant Madho Das, under Ex.1 Bhaitnama (Gift) in Samvat Year 1972 (Calendar year 1915). The learned trial court examined six witnesses on behalf of the plaintiff-appellants, besides documentary evidence produced by them, namely; P.W.1 - Ram Gopal Sharma (plaintiff no. 1), P.W.2- Raghunath Lohar, P.W.3 - Jabbar Singh, P.W.4 - Sohan Lal Sankhla, P.W.5 - Pritam Dadhich and P.W.6 - Ramesh Chandra, whereas, on behalf of the defendants, D.W.1 - Ramdin Gwala (Officer-in-charge & Inspector, Devasthan Department) was examined. 8. Thus, the issue relating to Trust in question being a Public Trust and not a Private Property or Trust was decided against the plaintiffs by the learned trial court also rejecting the plea of title through adverse possession, as above. 11. Before coming to the stand of the defendant State and the Devasthan Department and the various orders in seriatum passed by the various authorities of the Devasthan Department, it may be noted here that the sole foundation & sheet anchor of the plaintiffs case for treating the said Temple as their private Trust and private property is the alleged gift by the Maharani Ajab Kumari to Mahant Madho Das, the grand father of present three plaintiffs sons of late Banshi Lal. It will be appropriate to note the pedigree of this family and the 'Bhaitnama'/Inayat/Gift on which the entire claim of the plaintiffs is based. It may be, at the same time, mentioned that the said 'Bhaitnama/Gift Deed is an unregistered document and the writing of the said document is not decipherable and the full meaning & the purport of the same is not known and even though an un-authorized translation was produced for the perusal of this Court but this document was not proved, at least not properly proved by the plaintiffs before the trial court and, therefore, this Court does not consider it appropriate to allow the plaintiffs to go away with the claim of the said property as their private property solely on the basis of this document. Even if a presumption as per Section 90 of the Evidence Act was to be drawn, the contents of the said document were never proved by the plaintiff and therefore, this document is of little help to confer any title of the suit property to the present plaintiff appellants. 15. The Will dated 23.12.1977 was executed by Bansilal claiming himself to be son of Madhodas in favour of his youngest son Ram Gopal. 4. The Will dated 20.2.1981 was executed by Bansilal claiming himself to be son of Madho Das and describing his caste as Dadhich Brahmin now in favour of his other two sons, Bhanwarlal and Nandlal and his grandson. Orders passed by the Authorities of Devasthan Department from 1963 to 2004 : 16. Following orders were passed by the various authorities of Devasthan Department treating the said property as a Public Trust and the entire suit property of 7592 sq.yards as belonging to the said Public Trust, which are now discussed below. 16.1 On 19/9/1963 (Ex. A/3), the learned Assistant Commissioner, Devasthan Department, Jodhpur for the first time, on the complaint made by the local persons about the mismanagement of the said Temple of Shri Thakur ji Rajgopal Ji, after giving an opportunity of hearing to the non-applicant - Pujari Madho Das and his nephew Banshi Lal, father of the present three plaintiffs, held that the temple was a Public Trust and the non-applicant Banshi Lal was called upon to apply for registration of the said Trust as Public Trust under the provisions of the Act of 1959 and the details of the assets like gold & silver ornaments of the deity be called from the Household of the founder Rani Ajab Kumari, so that the inventory may be prepared for the same and the Temple may be taken over in the management of the State Government. However, the Commissioner, Devasthan Department was directed to hold an inquiry in the genuineness and veracity of the said Patta/'Bhaitnama' and send the report thereon. It is alleged by the plaintiffs before this Court that no such inquiry in pursuance of the said communication dated 23/7/1966 was actually held and no inquiry report with the relevant findings was ever submitted by the Commissioner of Devasthan Department. The contention on the other side by learned Addl. Advocate General Mr. P.S. Bhati was that the record of such correspondence showed that actually the plaintiff appellants' father Bansilal kept on seeking time on account of illness of his son and did not cooperate in such inquiry and did not even produce the original 'Bhaitnama' before the learned Commissioner on which such inquiry could be held and completed and as per their record, the enquiry proceedings were closed on 31.12.1978. Civil Writ Petition No. 2989/87 - Ram Gopal Sharma v. State , which came to be disposed of by the Division Bench relegating the petitioner Ram Gopal to the remedy under Section 22 of the Rajasthan Public Trust Act, 1959 by way of filing suit. It also appears that said Shri Ram Gopal Sharma approached the learned District Judge, Jodhpur, wherein, ad interim order was granted in his favour on 2/2/2008, which was later on vacated by the learned District Judge. These facts were noted by the Assistant Commissioner in his order dated 5/4/1994 registering the said Temple as a Public Trust in suo moto proceedings since the non-applicant Ram Gopal Sharma failed to file the requisite application by that time. Even though, later on, he is said to have filed a separate application for registering the Public Trust in a different name.
