JUDGMENT : 1. By this petition, filed in public interest, the petitioner has prayed for direction that the expenditure made on the advertisement by the ruling political party, using the fund of the State Government, may be prohibited. 2. In the order dated 15.09.2014, we had observed that a similar matter for the same reliefs in Writ Petition (Civil) No.13/2003 [Common Cause (Registered) Society through Sh. H.D.Shourie vs. Union of India] is pending in the Hon'ble Supreme Court, in which the Hon'ble Supreme Court has constituted a Committee consisting of three members to undertake the task of suggesting guidelines to this Court. The matter was adjourned till 25.11.2014, as the Supreme Court was seized of the matter, and in which the report of the Committee was awaited. 3. An application has been made by learned counsel appearing for the petitioner to implead the Union of India, through Secretary, Information & Broadcasting as party respondent. 4. Since the writ petition seeking the same reliefs is pending in Supreme Court since 2003, we do not propose to keep this matter pending. Any decision taken by the Supreme Court in the matter under Article 141 of the Constitution of India would be binding on all authorities in the country. It is not appropriate for this Court to keep a writ petition pending when the Supreme Court has taken notice, and is seized of the matter relating to the same issue. 5. The writ petition is, accordingly, disposed of with liberty to the petitioner to approach the Court, if anything survives, or for compliance of order of Supreme Court. The application for impleadment is rejected.
