JUDGMENT 1. (Oral) - The present Misc. Appeal under Section 28 of the Hindu Marriage Act, 1955 ('the Act of 1955') has been filed by the appellant-non-applicant-wife against the impugned order dated 30.01.2013 passed by the learned District Judge, Banswara in Civil Misc. Case No.26/2007 " Dilip Kumar v. Smt. Vimla Sharma" whereby, the application filed under Section 13 of the Act of 1955 by the respondent-husband-Dilip Kumar has been allowed and the decree of divorce has been granted against the present appellant-Smt. Vimla Sharma. 2. Both the learned counsels, Mr. Ranjeet Joshi and Mr. Narendra Thanvi, respectively appearing for the appellant-wife Smt. Vimla Sharma and the respondent-husband-LRs of late Dilip Kumar submit at bar that on account of successful mediation talks held between the parties in the present matrimonial case, in the present appeal filed against the grant of divorce decree granted in favour of the respondent-husband Dilip Kumar, who has unfortunately expired on 04.04.2013, the legal representatives of the late husband Dilip Kumar, i.e., the children, namely Smt. Roshni since married with one Jai Deep Thakur and Punit, aged 22 years, son of the respondent husband, have settled their dispute with the appellant-Smt. Vimla Sharma, their mother and the present Misc. Appeal may be disposed of in terms of the compromise arrived at between the parties. 3. Both the learned counsels for the parties submit that in view of the said compromise, the various cases between the parties pending before the different Courts arising out of the matrimonial dispute may be ordered to be disposed of in view of the aforesaid compromise by the Courts concerned, where such cases are said to be pending. The learned counsels also submit that the present Misc. Appeal may be disposed in view of the aforesaid compromise entered into between the parties. 5. The parties to the litigation, namely, Smt. Vimla Trivedi and Mr. Punit Trivedi are present-in-person before the Court. A Demand Draft No."636522" dated 21.11.2015 of Bank of Baroda, Thikariain the sum of Rs. 5,00,000/- (Rupees Five Lacs only), drawn in the name of Vimla Trivedi, after retaining a photostat copy of the same on record, has been handed over to the appellant-Smt. Vimla Trivedi. The parties before the Court have also signed the order-sheet in token of their presence and aforesaid agreement between themselves. Both the parties will be abide by the terms of the compromise in letter and spirit in future also. 6. Accordingly and in view of the above, the present Misc. Appeal filed on behalf of the appellant-wife-Smt. Vimla Trivedi stands disposed of in the light of the terms of the aforesaid compromise settling the present matrimonial dispute by mutual agreement. The concerned Courts below will dispose of the aforesaid pending cases in the light of the aforesaid compromise in accordance with law. No costs. A copy of this order be sent to the Court concerned and to the parties concerned forthwith.Appeal disposed of. *******
