Learned Additional Chief Judicial Magistrate, while exercising power vested u/s 156(3) Cr.RC. sent the said complaint to SHO, PS Kotwali, Dausa for investigation on which FIR No. 613/2015 for the offence u/s 420, 209 and 120B IPC was registered and investigation commenced. The matter is under investigation. 4. Investigating Officer, Mr. Dileep Singh, SI, PS Kotwali, District Dausa is present in person along with case diary. He has submitted factual report in the matter, which is taken on record. 5. Mr. Umesh Vyas, learned counsel for the petitioner submits that on the same allegations respondent no. 2 complainant previously lodged FIR No. 76/2014 for the offences u/s 420, 467, 166, 167, 193, 197, 209, 468 and 120B IPC, which was registered at Police Station Nangal Rajawtan, District Dausa in which after investigation negative final report was submitted by concerned SHO before the learned Additional Chief Judicial Magistrate, District Dausa wherein respondent no. 2 complainant submitted protest petition and after hearing on protest petition and considering the facts of negative final report, learned Additional Chief Judicial Magistrate, Dausa dismissed the protest petition and accepted the negative final report. Now, on the same allegations petitioner lodged another FIR No.613/2015 at Police Station Kotwali, Dausa which is not maintainable. 6. Mr. PC. Sharma, learned counsel for the respondent-complainant submits that petitioner is living with one Smt. Ramavatar Gurjar and having one issue from her and presently she is again pregnant from the petitioner, therefore, present FIR has rightly been lodged, therefore, this misc. petition may be dismissed. 7. Mr. N.S. Dhakad, learned Public Prosecutor on instructions submits that Investigating Officer has not considered the facts of the previous FIR No. 76/2014 registered at Police Station Nangal Rajawtan, Dausa. 8. After perusal of allegations levelled in FIR No. 76/2014 at Police Station Nangal Rajawtan and present FIR, it was stated that the same are almost similar, therefore, he fairly stated that second FIR is not maintainable. 9. Heard. 10. Since, the allegations levelled in the FIR No. 613/2015 registered at RS. Kotwali, District Dausa, u/s 420, 209 and 120B IPC had already been alleged by the petitioner in FIR No. 76/2014 registered at P.S. Nangal Rajawtan u/s 420, 467, 166, 167, 193, 197, 209, 468 and 120B IPC in which after investigation police submitted negative final report against which respondent no.
Kotwali, District Dausa, u/s 420, 209 and 120B IPC had already been alleged by the petitioner in FIR No. 76/2014 registered at P.S. Nangal Rajawtan u/s 420, 467, 166, 167, 193, 197, 209, 468 and 120B IPC in which after investigation police submitted negative final report against which respondent no. 2 complainant filed protest petition which also resulted in dismissal and the negative final report was accepted by the concerned court, therefore, allegations levelled in the FIR have attained finality. Now on the same allegations, it cannot be permitted to re-open the matter in subsequent FIR as such the subsequent FIR No. 613/2015 for the offence u/s 420, 209 and 120B IPC registered at RS. Kotwali, Dausa (Annexure-1) is not maintainable and the same is liable to be quashed.In view of the above, this misc. petition is allowed and the impugned FIR No. 613/2015 registered at P.S. Kotwali, District Dausa, u/s 420, 209 and 120B IPC is hereby quashed. 11. However, respondent-complainant will have liberty to raise his objection in defence during the proceedings pending u/s 125 Cr.RC. before the learned Family Court, Dausa. *******
