JUDGMENT Mrs. Daya Chaudhary, J.: (Oral) - The present petition has been filed under Section 439 Cr.P.C. for grant of regular bail to petitioner, namely, Jarnail Singh in case FIR No.98 dated 20.08.2013 registered under Sections 419, 420, 465, 466, 467, 468, 471, 477A and 120B of the Indian Penal Code at Police Station Mehatpur, District Jalandhar during the pendency of the trial. 2. Learned counsel for the petitioner submits that the petitioner has falsely been implicated in the case whereas no incriminating statement was ever made by him and he is in custody since 02.09.2013. Learned counsel further submits that challan has been filed and nothing is to be recovered from the petitioner. Learned counsel further submits that co-accused, namely, Nirmal Singh @ Nimma and Joginder Lal have already been granted regular bail in Criminal Misc. No.M-34053 of 2014 and Criminal misc. No.M-6247 of 2015 on 14.10.2014 and 23.04.2015 respectively. Even the charge has not been framed and trial may take long time to conclude. No purpose would be served by keeping the petitioner behind the bars. 3. Learned State counsel has not disputed the custody period and also the fact that co-accused, namely, Nirmal Singh @ Nimma and Joginder Lal have already been granted regular bail but opposes grant of bail to the petitioner. 4. Without commenting anything on the merits of the case and keeping in view the fact that the petitioner is in custody since 02.09.2013 and co-accused, namely, Nirmal Singh @ Nimma and Joginder Lal have already been granted regular bail; only challan has been presented; even the charge has not been framed and the trial may take long time to conclude, the present petition is allowed and petitioner, namely, Jarnail Singh is directed to be released on regular bail on his furnishing bail/surety bonds to the satisfaction of the trial Court.
