JUDGMENT Mr. Inderjit Singh, J.: - Custody certificate has been filed. Same is taken on record. 2. Prayer in the present application is for suspension of sentence of applicant-appellant Narinder Singh during the pendency of appeal. 3. Learned Judge, Special Court, Kapurthala, vide judgment of conviction and order of sentence dated 16.07.2015 held the applicant-appellant guilty for the commission of offence punishable under Section 22 of the Narcotic Drugs & Psychotropic Substances Act, 1985 and sentenced him to undergo rigorous imprisonment for a period of 02 years and to pay a fine of Rs.10,000/- under the aforesaid Section. 4. Feeling aggrieved against the said judgment of conviction and order of sentence, the applicant-appellant filed an appeal which has been admitted by this Court vide order dated 16.10.2015. 5. As per custody certificate, produced by learned State counsel, the applicant-appellant has already undergone 01 year and 02 days of actual sentence. 6. The appeal is not likely to mature for hearing in the near future. Keeping in view the facts and circumstances, the criminal miscellaneous application is allowed and the sentence of imprisonment of applicant-appellant during the pendency of appeal shall remain suspended and he is admitted to bail subject to his furnishing personal and surety bonds to the satisfaction of learned Chief Judicial Magistrate/Duty Magistrate, Kapurthala. ---------0.B.S.0------------
