JUDGMENT Anjani Kumar Mishra, J. The present application under Section 482 CrPC has been filed for early disposal of his bail application in Case No. 802 of 2015 (State Vs. Wasim Ahmad @ Anssari Ahamad), arising out of case crime no. 57 of 2015), under Sections 504, 506, IPC and 3(1)(X) SC/ST Act, PS Auraqi, District Gyanpur Bhadohi, pending before the ACJM, Gyanpur, Bhadohi. Heard. 2. Learned counsel for the applicant states that NBW has been issued against the applicant. He submits that applicant shall surrender before the court below at the earliest. However, he prays that his bail application may be considered and disposed of at an early date. 3. In the facts and circumstances of the case, it is provided that if the applicant files an application for recalling the non-bailable warrant, issued against the applicant in the said case within a period of 15 days from today, the same shall be considered and disposed of as expeditiously as possible in accordance with law. 4. Further, if the applicant surrenders within 15 days from today and applies for bail, the same shall be considered and disposed of, after hearing the Public Prosecutor, in view of the settled law laid down by the Seven Judges' decision of this Court in the case of Amarawati & another Vs. State of U.P., reported in 2004 (57) ALR 290, approved by the Apex Court in Lal Kamlendra Pratap Singh Vs. State of U.P. reported in 2009 (2) Crimes 4 (S.C.). 5. For a period of 15 days from today, or till the disposal of the application for grant of bail, whichever is earlier, no coercive action shall be taken against the applicant. 6. However, in case the applicant does not appear and surrender before the court below within 15 days from today, as directed above, the benefits of this order shall not be available to the applicant, and coercive action shall be taken in accordance with law.
