JUDGMENT : Vijay Bishnoi, J. This criminal misc. petition under Section 482 Cr.P.C. has been filed by the petitioners with the prayer for quashing the order dated 10.10.2007 passed by Chief Judicial Magistrate, Rajsamand whereby cognizance has been taken against the petitioners for the offences punishable under Sections 18 read with Section 16, 17 and 27 of Drugs and Cosmetics Act, 1940. 2. After attempting to argue the matter on merits, learned counsel for the petitioners has prayed to withdraw this criminal misc. petition, however, he seeks liberty for the petitioners to raise all their defences before the trial court at the time of framing charges. 3. Learned Public Prosecutor has no objection, if such liberty is granted to the petitioners. 4. Hence, this criminal misc. petition is dismissed as withdrawn with the liberty to the petitioners to raise all their defences before the trial court at the time of framing charges. The stay petition is also dismissed.
