JUDGMENT Mr. Inderjit Singh, J.:- Petitioners have filed this petition under Section 438 Cr.P.C. for grant of anticipatory bail in case FIR No.57 dated 06.04.2013 under Sections 323, 308, 452 and 34 IPC registered at Police Station Bhikhiwind, District Tarn Taran. 2. Notice of motion was issued and learned State counsel appeared and contested the petition. 3. I have heard learned counsel for the petitioners as well as learned State counsel and have gone through the record. 4. From the record, I find that in the present case, the petitioners were found innocent during the investigation and they have been summoned on an application under Section 319 Cr.P.C. to face trial before the Court. The petitioners are not required for any investigation or interrogation purposes as they have been summoned by the Court. The petitioners are only to face trial. The trial of the case will take long time. No useful purpose will be served by sending the petitioners to custody. Further, as per learned counsel for the petitioners, in view of the order passed by this Court, the petitioners have already appeared before the trial Court and have been released on interim bail by the trial Court. 5. Keeping in view the facts and circumstances of the case and without discussing the merits of the case in minute details and without expressing any opinion on the merits of the case, I find it a fit case where the petitioners are entitled to benefit of anticipatory bail. Therefore, the present petition is allowed. The orders dated 15.10.2015 and 16.10.2015 granting interim bail to the petitioners are made absolute. ---------0.B.S.0------------
