ORDER MUZAFFAR HUSSAIN ATTAR 1. Caveat 433/2015 is discharged. 2. The only ground taken in this Letters Patent Appeal (LPA) is that the selection process was initiated for supplying vacancies of Rehbar-i-Taleem (ReT) in Government Primary School, Mattibug, Yaripora, Kulgam, which, according to learned counsel for the Appellant, was a Notified Area and process of selection was initiated by issuance of Notification dated 23rd July, 2013 by treating the area as Notified Area. 3. In terms of Notification – SRO 530 dated 26th December, 2013, 02 wards, viz. Ward No.8 Mattibug and Ward No.9 stand deleted from the area covering Municipal Committee Yaripora. 4. Learned counsel for the Appellant submitted that notwithstanding the fact that Ward NOs. 8 & 9 ceased to be the areas covered by Municipal Committee Yaripora, the selection process, which was initiated on 23rd July, 2013, has, however, to be brought to its logical conclusion by treating Ward No.8 – Mattibug to be the area covered by Municipal Committee Yaripora. 5. Admittedly, the notification for initiation of selection process was issued on 23rd July, 2013 in respect of Mattibug area, which constitute Ward No.8 of Municipal Committee Yaripora. During the pendency of selection process, in terms of the aforesaid Notification – SRO 530 dated 26th December, 2013, Mattibug ceased to be the area covered by Municipal Committee Yaripora. After Ward No.8 was deleted from the area covered by Municipal Committee Yaripora, no selection/engagement could be made on the basis of area covered by Municipal Committee Yaripora, viz. Ward No.8. There is no Ward No.8 in existence after 26th December, 2013. The selection, as such, has to be made either by taking the revenue village or habitation as zone of consideration, if same satisfies the twin requirements contained in explanation to Government Order No. 288-Edu of 2009 dated 08th April, 2009. 6. For our above stated reasons, we do not find any illegality in the impugned order. 7. This Letters Patent Appeal is held to be meritless and is, accordingly, dismissed along with connected Ias.
