JUDGMENT 1. - Heard. Perused the material available on record. 2. The present revision petition has been filed by the petitioner through her natural guardian - father Sona Ram under Section 53 of the Juvenile Justice Act, 2000 challenging the order dated 28.10.2015 passed by the learned Sessions Judge, Jalore whereby he rejected the appeal filed by the petitioner under Section 52 of the Juvenile Justice Act, 2000 challenging the order dated 5.10.2015 passed by the learned Principle Magistrate, Juvenile Justice Board, Jalore in connection with F.I.R. No.292/2014 of P.S. Kotwali, Jalore, rejecting the prayer of the petitioner for her release on bail. 3. After hearing the arguments advanced at the bar and on going through the orders impugned, it is evident that the petitioner who is a juvenile girl has been implicated in this case with the allegation of destroying evidence of the offence under Section 302 IPC. Such offence would be punishable under Section 201 I.P.C. which is a bailable offence. 4. Thus, having regard to the facts and circumstances of the case and keeping in view the provisions of Juvenile Justice Act, but without expressing any opinion on the merits of the case, this Court feels that there are justifiable reasons for directing the release of juvenile to the guardianship of her father. 5. Accordingly, the revision petition succeeds. The order dated 28.10.2015 passed by the learned Sessions Judge, Jalore and the order dated 5.10.2015 passed by the learned Principle Magistrate, Juvenile Justice Board, Jalore are hereby set aside. The Principle Magistrate, Juvenile Justice Board, Jalore is directed to release the petitioner into the guardianship of her natural guardian father Sona Ram on the guardian executing a personal bond for a sum of Rs. 50,000/- along with two sound and solvent sureties in the sum of Rs. 25,000/- each to the satisfaction of the learned Principle Magistrate, Juvenile Justice Board, Jalore for the petitioner's appearance before the Board on the next date of hearing and as and when called for to do so during the course of the inquiry.Revision allowed. *******
