JUDGMENT Mr. Naresh Kumar Sanghi, J.: (Oral) - Prayer in this petition, filed under Section 439, Cr.P.C., is for grant of regular bail to the petitioner, Harjant Singh @ Janta, who has been booked for having committed the offence punishable under Section 22 of the Narcotic Drugs and Psychotropic Substances Act, 1985,(for brevity “N.D.P.S. Act”) in a case arising out of FIR No.96, dated 13.07.2015, registered at Police Station, Khamano, District Fatehgarh Sahib. 2. Learned counsel contends that on account of rivalry with the private person, the police has falsely implicated the petitioner in the present case; even if the whole case of the prosecution is taken at its face value then also the total weight of 720 tablets of lomotil, alleged to have been recovered from the petitioner, would come to 72 grams which is slightly above the weight of the non-commercial quantity of diphenoxylate salt allegedly disclosed by the prosecution; the report from the Forensic Science Laboratory/chemical examiner has not been received so far, therefore, the prosecution would not be in a position to state at this stage that the tablets recovered from the petitioner were containing the salt of ‘diphenoxylate’. He also points out that there are major flows in the investigation which will go to the root of the case and the petitioner is unlikely to be convicted even if the charge-sheet is presented by the Investigating Agency. He also points out that the petitioner is neither required nor involved in any other case relating to N.D.P.S. Act. 3. Learned counsel for the State submits that tablets recovered from the petitioner were containing the salt of diphenoxylate and were of commercial quantity but he fairly concedes that the total weight of the tablets so recovered is slightly above the weight of non-commercial quantity. He also fairly concedes that the petitioner is neither required nor involved in any other case relating to N.D.P.S. Act, and the report from the Forensic Science Laboratory/chemical examiner has not been received so far. 4. After hearing learned counsel for the parties, the present petition is accept. Petitioner, Harjant Singh @ Janta, s/o Shamsher Singh, r/o village Kalewal, P.S.Khamano, Fatehgarh Sahib, Punjab, is directed to be released on bail during pendency of trial of the present case, subject to his furnishing bail bonds to the satisfaction of learned Chief Judicial Magistrate/Duty Magistrate, Fatehgarh Sahib.
