JUDGMENT Mr. M.M.S. Bedi, J.: (Oral) - Petitioner seeks concession of bail in a case of recovery of 9 kg of heroin along with Rs. 7 lacs cash recovered from Sukhcharan Singh and Sohan Singh co-accused of the petitioner. 2. The petitioner has been involved in the case on the basis of disclosure statement made by his co-accused before the police as well as before the Court under Section 164 Cr.P.C to the effect that bags of heroin for delivery of different places recovered from the said accused had been given to them by the petitioner. Charges has been framed against the petitioner on 02.09.2015 under Section 29 of the NDPS Act. Though the role of the petitioner behind curtain appears to be serious but in view of no recovery having been effected from the petitioner, he can be granted the concession of bail. 3. Petition is allowed. Petitioner is ordered to be released on bail on his furnishing bail bonds/surety bonds to the satisfaction of the trial Court subject to the condition that petitioner will furnish an affidavit before his release that he would not indulge in any activity of which he is accused of during pendency of the trial. 4. In case of violation of said condition, it will be open to the prosecution agency to seek cancellation of bail. ---------0.B.S.0------------
