JUDGMENT 1. - By this writ petition, a challenge is made to the order dated 17th November, 2015 whereby the petitioner was declared ineligible for the post of Statistical Officer. 2. Learned counsel submits that petitioner is in second round of litigation. First litigation was initiated when qualification in computer was not taken to be equivalent, though petitioner was having B.Sc. in Computer. During the course of first writ petition, the respondents took a decision to treat the qualification obtained by the petitioner to be equivalent to the required qualification in computer. The petitioner was accordingly permitted to appear in the selection but is now shocked to receive the impugned order, by which, he has been declared ineligible. It is precisely for want of one year’s experience on or before 31st August, 2013. While passing the impugned order, the respondents failed to consider that petitioner is in possession of qualification of M.Sc. (Statistic) and therein, Statistic and ' Economics was one of the papers, hence, it was required to be treated to be equivalent of diploma in Statistic. The respondents failed to consider this aspect while passing the impugned order whereas as per the terms of advertisement, a candidate in possession of one years’ diploma course in Statistics is exempted from experience. In view of the above, the impugned ' order may be set aside and the petitioner may be held eligible for the post of Statistical Officer. 3. The qualification quoted above reveals requirement of Post Graduation and of computer. The candidate is further required to possess experience of minimum one year. The exemptions from experience have been given to certain set of candidates, which includes a candidate, who is having qualification of PG with first division or training of two years from a recognised institution or University. The exemption is also given to those, who are possessing one year diploma course in Statistics and Economics and lastly to the SC/ST candidates.

The petitioner is not in possession of any of the qualifications to seek exemption from the experience. The plea of learned counsel for the petitioner is that while undertaking M.Sc. (Statistics), he had undergone the course with Statistics and Economics subjects, thus it should be treated to be a case of one year’s diploma and be exempted from experience. The argument aforesaid is not tenable as the required qualification is not only PG in certain subjects but qualification of computer specified in the advertisement. The exemption from experience is given to those, who are having qualification of post graduation with the first division and, if one is additionally having two years’ training or one year’s diploma course, etc. The requirement of experience is not exempted for those, who are not in possession of one year diploma course and are having qualification of PG with second division. There is nothing on record to show that petitioner is in possession of qualification of one year diploma course in Statistics and Economics. 6. In view of the above, I do not find any illegality in the impugned order declaring the petitioner to be ineligible for the post. 7.
