JUDGMENT Mr. K.C. Puri, J.: (Oral) - Vide this common order, I intend to dispose of three petitions bearing CRM No. M-10966 of 2014 titled as, “Mohar Singh vs. State of Haryana”, CRM No. M-18719 of 2014 titled as, “Puran @ Chhanga vs. State of Haryana” and “, as the same have arisen out of the same FIR. 2. The petitioners have applied for grant of regular bail in FIR No. 151 dated 08.09.2011 under Sections 15/16/17/18/27- A/21/61/85 of the Narcotic Drugs and Psychotropic Substances Act (in short “the NDPS Act”) registered at Police Station Ding, District Sirsa. 3. So far as petitioner Mohar Singh is concerned, this is the first bail petition. 4. So far as petitioner Puran @ Chhanga is concerned, this is third bail petition. The earlier two bail petitions were decided on merits. 5. So far as petitioner Ram Kishan is concerned, this is second bail petition. The earlier bail petition was dismissed as withdrawn. 6. I have heard learned counsel for the parties and have gone through the records. 7. So far the petitioners Mohar Singh and Puran @ Chhanga are concerned, it is alleged that on seeing the police party, they ran away from the spot and recovery is of 100 kgs poppy husk and 200 kgs of chura post (doda post). 8. The quantity recovered is commercial in nature. So, no ground for grant of regular bail qua Mohar Singh and Puran Singh @ Chhanga is made out. 9. When this court is not inclined to accept the prayer, learned counsel for petitioner Mohar Singh wishes to withdraw the present petition. 10. So, the bail petition qua Mohar Singh stands dismissed as withdrawn. 11. The petition qua Puran @ Chhanga stands dismissed. 12. So far as the petition qua petitioner Ram Kishan is concerned, the allegations against him are that the contraband was taken to his Dhani and later on it was recovered from Dhani of Sajjan Singh. It is further submitted that Sajjan Singh has been allowed the concession of bail by this court vide order dated 09.07.2014 passed in CRM No. M-38556 of 2013. The case of Ram Kishan is better than that of Sajjan Singh. 13. So, without commenting on the merits of the case, his petition stands allowed.
