JUDGMENT 1. - The present second appeal under Section 100 of the Code of Civil Procedure has been filed by the appellant-plaintiff in a suit for permanent injunction and mandatory injunction against the judgment and decree dated 16.09.2015 passed by the learned Additional District Judge No.1, Abu Road, District Sirohi in Civil Appeal Decree No.22/2012 "Municipal Board, Abu Road v. Rajendra Singh" by which, the learned First Appellate Court has reversed the judgment and decree dated 27.03.2012 passed by the learned Civil Judge (Junior Division), Abu Road, District Sirohi in Civil Original Suit No.42/2005 "Rajendra Singh v. Municipal Board, Abu Road" by which, the learned Trial Court, while allowing the suit of the plaintiff and restrained the Municipal Board from dispossessing the plaintiff and directed for considering his case for regularisation of the shop in question. 2. 2. Being aggrieved by the aforesaid judgment and decree dated 27.03.2012, the Municipal Board, Abu Road has filed the appeal before learned First Appellate Court of the Additional District Judge No.1, Abu Road which was came to be allowed and the judgment and decree of the learned Trial Court dated 27.03.2012 was set aside. The learned counsel, Mr. Vijay Purohit, appearing for the appellant-plaintiff-Rajendra Singh submitted that the respondent-Municipal Board, Abu Road ought to have considered the case of the plaintiff for regularisation of the possession over the land in question, as directed by the learned Trial Court but the Municipal Board, Abu Road has failed to do so. 5. Having heard the learned counsel, Mr. Vijay Purohit, appearing for the appellant-plaintiff-Rajendra Singh S/o Jagmohan Singh and upon perusal of the material available on record, it is needless to say that it is always open for the plaintiff and the respondent-Municipal Board to take resort to the said course, therefore, in this view of the matter, it is considered expedient to observe that if the plaintiff-Rajendra Singh S/o Jagmohan Singh applies for regularisation of his possession over the suit shop in question, it is for the respondent-Municipal Board, Abu Road to decide such application of the plaintiff in accordance with law; and that can be done even now without interference by this Court. 6. Therefore, this Court is of the opinion that the present second appeal is liable to be disposed of with the aforesaid liberty to the plaintiff and direction to the respondent-Municipal Board. 7. Accordingly and in view of the above, the present second appeal filed on behalf of the appellant-plaintiff Rajendra Singh S/o Jagmohan Singh stands disposed of with the aforesaid liberty to the plaintiff to approach the respondent Municipal Board, Abu Road seeking regularisation of his possession over the said plot of land in question and if the plaintiff moves any such application, it is expected of the respondent-Municipal Board, Abu Road to consider and decide such application in accordance with law and subject to realisation of the market price of the land in question. No costs. A copy of this order be sent to the Courts below and to the parties concerned forthwith.Appeal disposed of. *******
